I wanted to drop this one quickly because after reading the SCOTUS decision ending Affirmative Action at US colleges, I had to note something I found interesting-
The blistering attacks by Justices Roberts and Thomas on the horrific logic of the dissenting arguments were striking and hilarious. Let’s review (for the full decision you can go here) :
If you want the main takeaway of the decision, here it is in one sentence:
Eliminating racial discrimination means eliminating all of it.
Boom…
In a footnote, Roberts bodyslams Justice Jackson for saying the rejection of two black students over five years at UNC is a sign of discrimination:
Classifications of race are incoherent and, in essence, racist themselves:
When the school’s practices were questioned, their response was essentially, “trust us.” Roberts responded with “no thanks…”
When Jackson says SCOTUS should “trust the experts” (interesting legal theory), Roberts again retorts with “no thanks…”
Data is presented that shows an amazingly (almost intentional) consistency in the racial make-up of Harvard’s incoming classes by their admission department.
Sotomayors response to this damning data is to respond with data that predates these time periods by 25 years. Roberts is having none of it…
Sotomayor once again decides to dismiss the law and says that affirmative action must continue until racial inequality is over, even though the court had ruled several times before that was not the case.
Then Roberts lets loose:
Read the last three lines again…ooof.
Now Thomas comes in. Aside from the legality of AA, show him that it works in the first place. No can do…
On the “trust us” front Thomas has some thoughts as well...
Oh…my…God…
Thomas points out that AA uses the same arguments to utilize race in their decision-making process as racists do in theirs:
Next he smacks down Sotoymayor’s “racism doesn’t really hurt anyone” argument…
Next up for Thomas’s wrath is turned onto the other black Justice, Jackson…
Thomas, with the casual Thomas Sowell quote for bonus points…
Next comes an absolutely vicious attack from Thomas. Can we call the fight already? Jackson’s arguments are already dead…

I specifically want to call out that third paragraph:
This sounds like a great argument for an economically based fairness policy. It sounds like a racist argument to assume no minorities fit into these buckets.

Supreme Court Smackdown
I feel like Clarence Thomas has had his dissenting opinion locked and loaded for years. The man was prepared.
Good show Gordon. So satisfying to read this. I wonder what you would say about the il-liberal media's frenzied efforts to discredit the Supreme Court, expecting that this ruling was coming. Their endless hit jobs on Thomas and Alioto. This is a very fulfilling post - thank you.
